WHAT IT SAYS: #

ARTICLE II – Property; Liability

2.0     All property of the Club shall include, but not be limited to, Clubhouse(s), swimming pools, tennis courts, carts, and grounds suitable for playing golf and for participating in other athletic sports, and such other property and facilities as may be necessary for its purposes (sometimes referred to herein as the “facilities”).

  • The Club will not, under any circumstances, be responsible for property of Members, visitors, guests or other persons brought on the premises for any purpose whatsoever.
  • Property of the Club shall not be loaned or removed from the premises, or be put to other use than that for which it was intended.
  • Members must pay for all breakage or damage to, or loss of, Club property caused by them, their family members or their guests.
  • No Member or any other person shall have or acquire any ownership interest in or property rights in the property assets or holdings of the Club, except as provided in the Articles of Incorporation of the Club or these Bylaws.
  • A Member shall be personally liable for the charges, property damage caused by, and the acts or omissions of his guests.
  • If any of the Club facilities are unavailable for Membership use due to fire, casualty, construction, remodel or other similar occurrence, the Member will continue to be responsible for the payment of all dues.
  • While using the facilities or participating in Club events, whether on or off the premises, Members and their spouses, dependents, and guests are charged with the responsibility of using proper judgment and caution at all times. The Club does not assume any liability for injuries caused to or incurred by any Member, user, or guest or for damage to property resulting from the use of the facilities. In consideration of the privileges described herein, each Member and each person using the facilities, equipment and amenities of the Club through a Member’s membership, expressly agrees that (i) all use of the Club’s facilities, equipment and amenities is undertaken at the sole risk of the user, and the Club shall not be liable for any injuries or damages to any Member or any other persons; and (ii) the Club and its affiliates, officers, directors, managers, members, agents and employees shall not be subject to and are hereby released and forever discharged from any claims or demands whatsoever, including, without any limitation, those claims or demands resulting from acts or omissions of active or passive negligence on the part of the Club or its affiliates, officers, directors, shareholders, managers, members, agents or employees.

WHAT IT MEANS: #

  • Our Assets: The Club boasts a variety of facilities designed for enjoyment and activity, including clubhouses, swimming pools, tennis courts, and golfing amenities. These resources are integral to our operations and member experience.
  • Personal Belongings: Members and guests are responsible for the safety and security of their personal possessions while on Club premises. The Club cannot assume responsibility for these items.
  • Usage of Club Facilities: All properties and amenities of the Club are to be used as intended and remain on the premises. Unauthorized removal or misuse of these assets is not permitted.
  • Accountability for Damages: Should any Club property be damaged or lost due to the actions of a member, their family, or guests, the responsible party will be expected to cover the costs of repair or replacement.
  • Ownership and Rights: Membership does not confer any ownership interest in the Club’s physical assets or financial holdings. This principle is upheld unless specifically outlined in our Articles of Incorporation or Bylaws.
  • Guest Responsibilities: Members will be held accountable for the conduct of their guests, including any damages incurred or debts accrued during their visit.
  • Continued Dues: Membership dues remain obligatory, even if Club facilities are temporarily unavailable due to renovations or unforeseen circumstances.
  • Safety and Liability: We encourage all members and their guests to engage with our facilities and events with a mindset of safety and responsibility. The Club disclaims liability for injuries or damages sustained during use of the Club’s resources. By participating in Club activities, members and guests agree to this understanding, acknowledging the assumption of risk involved.
